On this page you will find all the general conditions governing the sale of our tourist services. The purpose of these conditions is to provide you with clear information about booking, payment and cancellation procedures, as well as your rights and obligations as a customer.

We invite you to read them carefully before making any booking. By confirming an order, you accept these terms and conditions without reservation.

CONDITIONS OF SALE FOR TOURIST PACKAGES AND SERVICES AS OF JANUARY 1, 2021
OF THE SAINT GERMAIN BOUCLES DE SEINE INTERCOMMUNITY TOURIST OFFICE

In accordance with Article R211.4 of the Tourism Code, the purpose of these special conditions of sale is to inform the customers of the Saint Germain Boucles de Seine Intercommunal Tourist Office (OTI), prior to signing the contract, of the information provided for in the aforementioned article.
In accordance with article L211.9 of the French Tourism Code, this pre-contractual information will form an integral part of the contract and may only be modified by express agreement between the parties.The applicable CPVs are those in force at the time of registration.
These CPVs are communicated to the customer at the time of booking a service with the tourist office and can be consulted and downloaded from the website: www.seine-saintgermain.fr

Standard Information Form – Internet Package Travel
The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302 and Article L.211-2 II of the French Tourism Code. You will therefore benefit from all the rights granted by the European Union applicable to packages, as transposed into the Tourism Code. The Saint Germain Boucles de Seine Intercommunal Tourist Office will be entirely responsible for the proper execution of the package as a whole. In addition, as required by law, the Saint Germain Boucles de Seine Intercommunal Tourist Office has protection to refund your payments and, if transport is included in the package, to ensure your repatriation in the event that it becomes insolvent.
Essential rights under Directive (EU) 2015/2302 transposed into the Tourism Code:
Travellers will receive all essential information about the package before entering into the package travel contract.
The organiser as well as the retailer are responsible for the proper performance of all travel services included in the contract.
Passengers will be provided with an emergency telephone number or contact details to enable them to reach the organiser or retailer.
Passengers may transfer their package to another person, subject to reasonable notice and possible payment of additional costs.
The price of the package may only be increased if specific costs increase (e.g. fuel prices) and if this possibility is explicitly provided for in the contract, and may in any case not be changed less than twenty days before the start of the package. If the price increase exceeds 8% of the package price, the traveller may cancel the contract. If the organiser reserves the right to increase the price, the traveller is entitled to a price reduction in the event of a reduction in the corresponding costs.
Travellers may cancel the contract without paying any cancellation fees and receive a full refund of payments made if one of the essential elements of the package, other than the price, undergoes a significant change. If, before the start of the package, the professional responsible for the annual package cancels it, travellers may obtain a refund and compensation, if applicable.
Travellers may cancel the contract without paying a cancellation fee before the start of the package in the event of exceptional circumstances, for example if there are serious safety problems at the destination that are likely to affect the package.
In addition, travellers may, at any time before the start of the package, cancel the contract subject to payment of appropriate and justifiable cancellation costs.
If, after the start of the package, important elements of the package cannot be provided as planned, appropriate alternative services must be offered to travellers at no extra charge. Travellers may cancel the contract without paying cancellation fees if the services are not performed in accordance with the contract, if this significantly disrupts the execution of the package and if the organiser does not remedy the problem.The organiser or retailer must provide assistance if the traveller is in difficulty.
If the organiser or retailer becomes insolvent, the amounts paid will be refunded. If the organiser or retailer becomes insolvent after the start of the package and if transport is included in the package, the repatriation of travellers is guaranteed. If you purchase this travel service, you will benefit from the rights granted by the Tourism Code. The Saint Germain Boucles de Seine Intercommunal Tourist Office is responsible for the proper execution of the travel service. In addition, as required by law, the Saint Germain Boucles de Seine Intercommunal Tourist Office has protection to refund your payments in the event that it becomes insolvent.

Travellers will receive all essential information about the travel service before concluding the travel contract.
The service provider as well as the retailer are responsible for the proper performance of the travel service.

If, after the start of the trip, important elements of the trip cannot be provided as planned, appropriate alternative services must be offered to travellers, at no extra cost. Travellers may cancel the contract without paying cancellation fees if the services are not performed in accordance with the contract, if this significantly disrupts the execution of the trip and if the service provider does not remedy the problem.The service provider or retailer must provide assistance if the traveller is in difficulty.
If the service provider or retailer becomes insolvent, the amounts paid will be refunded. Special terms and conditions of sale
General public services – from 1 January 2021
PREAMBLE

In accordance with Article L211-8 of the French Tourism Code, the purpose of these special terms and conditions of sale is to inform customers of the tourist office of the content of the services offered relating to transport and the stay, the price and terms of payment and the cancellation conditions. In accordance with article L211-9 of the French Tourism Code, the Tourist Office reserves the right to make changes to these special conditions of sale, in which case this information will be brought to the attention of interested parties in writing. One of the main missions of the Tourist Office is to promote tourism in the area. The Saint-Germain Boucles de Seine Intercommunal Tourist Office cannot be held responsible for the poor execution of services offered by service providers in its area.

RESERVATIONS
Registration is compulsory for each service. Registration is open at least one month before the date of the service. Reservations become effective once the customer has purchased a ticket, which implies full acceptance of the general and special terms and conditions of sale. The Tourist Office reserves the right to refuse any person who turns up spontaneously at the meeting point on the day of the service without a reservation. The ticket is only valid for the place, session, date and time.

TARIFFS

The prices of our services are firm and global. Prices include any entrance fees, the guide’s service and the snack if there is one, as well as booking fees.

RETRACTION
The right of withdrawal does not apply to accommodation, transport, catering, ticketing or leisure services that are provided on a specific date or during a specific period in application of article L.121-20-4 of the French Consumer Code.

Payment terms
Payment must be made before the service is provided:
At the Saint Germain Boucles de Seine Intercommunal Tourist Office: in cash, by cheque (made payable to the OTI Saint Germain Boucles de Seine) or by credit card. At the Tourist Information Office in Marly-le-Roi: in cash or by cheque (made payable to the OTI Saint Germain Boucles de Seine). PERSONAL EFFECTS
The tourist office recommends that each participant looks after their personal effects and declines all responsibility in the event of loss or theft.

CONDITIONS ON CANCELLATION
Cancellation due to the tourist office
In this case, the tourist office must inform the customer by post or email, with acknowledgement of receipt. Without prejudice to any claims for damages, the customer will be reimbursed the amount paid within 60 days without penalty. These provisions do not apply where an amicable agreement has been reached for the customer to accept a substitute service offered by the Tourist Office. If the tourist office has to modify programmes, distribution or timetables, the ticket will not be exchanged or reimbursed.

Cancellation by the customer
In the event of cancellation by the customer, no reimbursement will be made, except on presentation of a medical certificate bearing the customer’s name and expressly stating that the pathology has led to a contraindication to the service. Refunds will be made by bank transfer on presentation of a bank details form. Once payment has been received, the ticket cannot be taken back or exchanged, even in the event of loss or theft. No duplicates will be issued and any resale is prohibited.

CASES OF FORCE MAJEURE
If the event is interrupted for more than half its duration or cancelled due to circumstances of force majeure, such as – by way of example but not limitation – the occurrence of a natural disaster, an armed conflict, a labour dispute, an imperative injunction from the public authorities, a disruption to transport and/or the supply of raw materials or an operating accident, i.e. the occurrence of an event that the tourist office had no possibility of foreseeing, which will be beyond its control and unable to overcome despite its diligence and efforts to resist it – the ticket will not be subject to any refund.

PERSONAL DATA PROTECTION
The tourist office is likely to collect personal data required for IT processing of your registration, online purchase, for sending newsletters, promotions or as part of quality surveys (via email, telephone calls and postal mail).

Type of data collected

On the basis of legitimate interest, L’Office de Tourisme may collect name, postal address, e-mail address, telephone numbers, as well as order history, after-sales service interventions, preferences and centres of interest, elements relating to the tracking of an order, its delivery and payment.

In the interests of minimisation and transparency, L’Office de Tourisme only collects the data necessary to manage the purchase of “Products”. This personal data must be entered in order to process orders.

Data collection methods

The data collected by the Tourist Office is communicated voluntarily by the user when purchasing a product on the site or when placing an order. On our site, data is collected via our online forms, and users are asked to provide us with information in mandatory fields marked with an asterisk. Information on the user’s rights relating to the French Data Protection Act is specified on each form.

To keep the user informed about commercial operations and/or events (consents).
For statistical analyses to find out overall trends in the use of the services offered, to find out users’ preferences, and to analyse browsing behaviour (consent for the collection of cookies)
Security and storage of data

The Tourist Office takes all appropriate measures to maintain an appropriate level of confidentiality and security of data of a personal or sensitive nature.

In the context of orders, purchases and transactions, the user’s personal data will be kept for the entire legal period required in compliance with RGPD compliance rules.

Below are the retention periods for personal or sensitive data lawfully collected:

Management of files and newsletter subscriptions (anonymised after 5 years without any interaction with our services);
Management of requests for information and brochures (deleted after 5 years without any interaction with our services and if no file has been created or no subscription to one of our newsletters is still active);
Credit card data following a payment is never stored, either during or after the transaction, on the Tourist Office website.

Exercising the right to access, rectify and delete data

The user has the right to access, rectify and delete data concerning him. He/she may therefore exercise this right of access, rectification and deletion under the conditions set out in Law 78-17 of 6 January 1978 relating to compliance with Regulation No. 2016⁄679 of 25 May 2018 (RGPD).
If a user wishes to object to the processing of their personal data previously collected by the Tourist Office, or to obtain information on issues relating to their data, they may contact the Data Protection Officer (DPO) appointed by the Director of the Tourist Office in the following manner:

By email by writing to communication@seine-saintgermain.fr, specifying “Action on the processing of my personal data” in the subject line;
By post to the following address: Délégué à la Protection des Données, Office de Tourisme Saint Germain Boucles de Seine, 3 rue Henri IV (Jardin des Arts), 78100 Saint-Germain-en-Laye.
Users may also define directives relating to the fate of their personal data after their death in the same way.

In the event of a dispute, the User has the right to refer the matter to the CNIL.

INTELLECTUAL PROPERTY / PHOTOS / ILLUSTRATIONS
The photos, maps and illustrations contained in the brochures and/or the website are illustrative and are not contractual in nature. Any reproduction or commercial or non-commercial use of these elements is strictly prohibited without prior written authorisation.
The repeated and systematic extraction of protected or non-protected elements from the www.seine-saintgermain.fr website causing any prejudice whatsoever to the Saint Germain Boucles de Seine Intercommunal Tourist Office or to one of its service providers or suppliers is also prohibited.

LITIGATION
These special conditions of sale are subject to French law. Any complaint relating to a service must be sent by letter to the Tourist Office, which alone is competent to issue a decision on disputes, within 5 days of the start of the service.
One of the main missions of the Tourist Office is to promote tourism in the destination. The Saint Germain Boucles de Seine Intercommunal Tourist Office cannot be held responsible for the poor execution of services offered by service providers in its area.

Special terms and conditions of sale
Group bookings – from 1st January 2021

PREAMBLE
In accordance with Article L211-8 of the French Tourism Code, the purpose of these special terms and conditions of sale is to inform the Tourist Office’s customers, prior to signing the contract, of the content of the services offered relating to transport and the stay, the price and payment terms, and the conditions for cancelling the contract.
In accordance with article L211-9 of the French Tourism Code, the Tourist Office reserves the right to make changes to these special terms and conditions of sale, in which case this information will be brought to the attention of those concerned in writing before the contract is concluded.

ARTICLE 1- RESERVATIONS
Reservations will only be recorded on receipt of the “reservation contract” duly completed and signed. It must be accompanied by a cheque or bank transfer for 30% of the total cost of the service, which must be received by the Intercommunal Tourist Office three weeks before the date of the service.
For standard guided tours (without entrance fee and ancillary services), the full balance of the service will be due 48 hours before the visit. There will be no deposit to pay.
Any reservation implies acceptance of the general and special terms and conditions of sale.

ARTICLE 2 – WITHDRAWAL
The right of withdrawal does not apply to accommodation, transport, catering, ticketing or leisure services that are provided on a specific date or during a specific period in application of article L.121-20-4 of the Consumer Code.

ARTICLE 3- PAYMENT OF THE BALANCE
The customer formally undertakes to pay the balance of the agreed service by any means at his/her convenience 48 hours before the date of the service.
In the case of payment by administrative order, the customer will provide the Intercommunal Tourist Office, no later than 48 hours before the day of the service, with the administration’s undertaking to pay the total amount.
A customer who has not paid the balance by the agreed date is considered to have cancelled the service.

ARTICLE 4- SERVICES
The prices of our services include the services of a tour guide and entrance fees to tourist sites for “discovery afternoons” and “tours”, and lunch for “tours”.

ARTICLE 5- TIMETABLE
The customer must arrive on the date and at the time indicated on the contract. If this is not possible or if they arrive late, they undertake to inform the tourist office, whose contact details are given below.
If the group is late, the visits will be shortened or extended, depending on the availability of the tour guide, and in the latter case, the service may be increased.
If the tour guide is not informed of the delay, he/she is not obliged to wait for the customer for more than 30 minutes.
During the trip, the smooth running of the day requires that the times indicated by the guide be respected. As far as the return journey is concerned, the times given in the programme are based on normal traffic conditions. We accept no responsibility for any delays.

ARTICLE 6- PERSONAL EFFECTS
The Tourist Office recommends that each participant looks after his or her personal effects and accepts no responsibility in the event of loss or theft.

ARTICLE 7- CANCELLATIONS
7.1 CANCELLATION BY THE TOURIST OFFICE
In this case, the Tourist Office must inform the customer by post or e-mail, with acknowledgement of receipt. Without prejudice to any claims for damages, the customer will be reimbursed the amount paid within 60 days without penalty. These provisions do not apply where an amicable agreement has been reached for the customer to accept a substitute service offered by the tourist office.
The tourist office reserves the right to modify or cancel any “tour” 22 days before the departure date if the number of people registered was less than 12; in this case, the reservation will be reimbursed in full.

7.2 CANCELLATION BY THE CUSTOMER
A cancellation by the customer will result in the following deductions:
– Before the 21st day before the date of the service: the deposit paid will be refunded. The refund will be made by bank transfer on presentation of a bank details form.
. From the 21st to the 3rd day before the date of the service: the deposit paid will not be refunded.
. From the 2nd day to the day of the service: the full price of the service is payable by the customer.
Any cancellation must be notified by registered post with acknowledgement of receipt addressed to the tourist office, as evidenced by the postmark.
In the event of no-show or late departure, no refund will be made.

7.3 CASE OF FORCE MAJEURE
If a cancellation or modification is imposed by circumstances of force majeure, such as – by way of example but not limitation, the occurrence of a natural disaster, armed conflict, industrial dispute, imperative injunction from the public authorities, a disruption to transport and/or the supply of raw materials or an operating accident, i.e. the occurrence of an event that the tourist office had not had the opportunity to foresee, which will be beyond its control and unable to overcome despite its diligence and efforts to resist it – the service will not be subject to any reimbursement.

ARTICLE 8 – PROTECTION OF PERSONAL DATA
The Tourist Office is likely to collect personal data necessary for the computer processing of your registration, its follow-up, the sending of newsletters, promotions and solicitations or as part of quality surveys (via e-mail, SMS messages, telephone calls and post). You may unsubscribe at any time by clicking on the hypertext link provided for this purpose at the bottom of each communication, by sending an e-mail to communication@seine-saintgermain.fr or by sending a letter to the following address: Office de Tourisme Intercommunal Saint Germain Boucles de Seine, Jardins des Arts, 3 rue Henri IV, 78100 SAINT-GERMAIN-EN-LAYE, with proof of identity.
In accordance with the RGPD, you have the right to access and rectify, update, portability and deletion of your personal data, which you may exercise by contacting the data controller at Office de Tourisme Intercommunal Saint Germain Boucles de Seine.
Unless you notify us to the contrary by limiting or objecting to the processing of your personal data, we reserve the right to use this information to send you the various documents mentioned above.
You also have the right to lodge a complaint with the CNIL.

ARTICLE 9- INTELLECTUAL PROPERTY / PHOTOS / ILLUSTRATIONS

ARTICLE 10 – ASSIGNMENT OF THE CONTRACT
The assignor must inform the Tourist Office of the assignment of the contract by registered letter with acknowledgement of receipt no later than 15 days before the start of the service, indicating precisely the name and address of the assignee and that the latter has the same conditions as the assignor for carrying out the service.
As an indication, the operations following this transfer may entail costs of between €20 and €50 depending on the number of people, the type of service and the proximity of the start of the service.

ARTICLE 11 – DISPUTES
These special conditions of sale are subject to French law. Any complaint relating to a service must be sent by letter to the tourist office, which has sole jurisdiction to rule on disputes, within 5 days of the start of the service.
In the event of persistent disagreement, disputes may be submitted to the quality department of the Fédération Nationale des Offices de Tourisme et Syndicats d’Initiative, 11 rue du Faubourg Poissonnière, 75009 Paris, which will endeavour to reach an amicable agreement.
Any dispute that cannot be settled amicably will be referred exclusively to the TGI of Versailles in the case of a legal entity, and to the competent court in accordance with article L.141-5 of the Consumer Code, in the case of a legal entity. of the Consumer Code, for an individual.
